Barry Weintraub explained the law on limitation periods applying to the collection of rents in a Law Times article “Commercial leases present deadline challenges”. When limitation periods were standardized at two years in 2002, the law on matters relating to real property was left untouched, and lawyers have been dealing since then with the boundary between the old and current rules in claims for rent, which are the “classic overlap” between claims for money and claims from land ownership: “It is a claim for money arising out of the use of land,” he said.
