Enforcement of Foreign Judgments Discussed by Barry Weintraub
Barry Weintraub gave an update at a conference in Ottawa on November 3, 2017 to assembled lawyers from Justice Canada and the Canadian Bar Association National Environment, Energy & Resources Law Section on the enforcement of foreign judgments in Canada against subsidiaries of multinational judgment debtors, in the context of an Ecuadorean judgment in a class action against Chevron Corporation (dubbed by Chevron as the “fraud of the century”), including a recent Ontario Court of Appeal Decision in Yaiguaje v. Chevron Corp., 2017 CanLII – 2017 ONCA 827 (CanLII) setting aside an order that the judgment creditor appellants pay security for the costs of the appeal.
